Terms of Use

These terms are an agreement between you and Cappsule (France), the maker of Nouma. By downloading or using the Nouma iPhone app or this website, you agree to them. If you don’t agree, please don’t use Nouma.

1. What Nouma is

Nouma is a baby sleep tracking app for children aged roughly 0–2 years. It lets parents and caregivers log sleep and daily care, shows predictions learned from that log, offers soothing sounds and short educational lessons, and — with an optional account — provides AI features and syncing between two caregivers.

2. Not medical advice

Nouma is not a medical device and provides no medical advice. Predictions, insights, lessons, AI answers and sleep plans are general, informational content generated from patterns in the data you enter. They are not a diagnosis, treatment or monitoring of any condition, and they can be wrong. Always consult a pediatrician or qualified health professional for concerns about your child’s sleep, health, feeding or development, and in an emergency contact emergency services. Never delay seeking medical advice because of something Nouma showed you.

3. Your account

The core app works without an account. If you create one, you must provide a valid email address that you control. You are responsible for what happens under your account and for keeping access to your email secure, since sign-in works by magic link and one-time code. You can delete your account at any time in the app; deletion removes your synced data from our servers immediately.

4. Subscriptions and billing

  • The core app is free. Premium features are unlocked by the Nouma Plus subscription.
  • Nouma Plus starts with a 1-week free trial, then costs €4.99 per month, €11.99 per 3 months, or €34.99 per year (prices may vary by region and are shown in the App Store before you confirm).
  • Subscriptions are billed to your Apple App Store account and renew automatically at the end of each period unless cancelled at least 24 hours before renewal.
  • You manage and cancel the subscription in iOS Settings → your name → Subscriptions. Cancelling stops future renewals; you keep Plus until the end of the paid period. Apple’s refund rules apply to purchases made through the App Store.
  • Unused portions of a free trial are forfeited when a subscription begins. Starter credits granted to new accounts are a free goodwill allowance, have no monetary value and may not be exchanged or refunded.

5. Acceptable use

You agree not to:

  • use Nouma unlawfully, or to enter data about a child you have no parental or caregiving authority over;
  • attempt to break, probe or overload our servers, or to access another household’s data;
  • misuse the AI features — including attempts to generate harmful content or to extract other people’s data;
  • resell, sublicense or offer Nouma as a service to third parties;
  • copy the app’s content (lessons, sounds, artwork) outside the app except for your personal, non-commercial use.

We may suspend or terminate accounts that break these rules. Where reasonable, we will warn you first.

6. Your data and our content

The data you enter about your baby is yours. You give us the limited license needed to store, sync and process it to run the service — nothing more. Nouma itself — the app, artwork, lessons, sounds, and this site — belongs to Cappsule or its licensors and is protected by intellectual property law.

7. Availability and changes

We work hard to keep Nouma reliable, and the core app is designed to work offline even when our servers don’t. Online features (sync, AI, sign-in) are provided “as available”: we may change, suspend or discontinue features, and we will give notice in the app of changes that materially reduce what a paid subscription includes.

8. Limitation of liability

To the maximum extent permitted by law, Nouma is provided “as is”, and Cappsule is not liable for indirect or consequential damages, lost data caused by factors outside our control, or decisions you make based on the app’s content (see section 2). Where liability cannot be excluded, it is limited to the amount you paid for Nouma in the 12 months before the claim. Nothing in these terms excludes liability that cannot legally be excluded, including under French consumer law, or limits your statutory rights as a consumer.

9. Governing law

These terms are governed by French law. Disputes go to the competent courts of France, without depriving you of protections granted by mandatory consumer-protection rules of your country of residence. EU consumers may also use the European Commission’s online dispute resolution platform.
